THE REIMBURSEMENT OF REPAIR COSTS WITHOUT MwSt
IN BRITISH FORCES GERMANY

Tax-Free Agreement In respect of whether traffic accident repairs can be carried out free of MwSt. about which there still appears to be a degree of misunderstanding.

The simple answer is yes .... but certain conditions apply.

There is an agreement with the German finance authorities which allows for the cost of traffic accident repairs to be billed/ paid free of tax (MwSt.) when they are carried out on a private vehicle owned by an entitled member of BFG. The tax-relief is permitted irrespective of who is at fault and regardless of how severely the vehicle is damaged but the concession only applies to the cost of repair to the vehicle owned by the entitled member of BFG, it does not apply to the other individuals car if he/she is a non-entitled (non-SOFA-status) person.

The procedure is that the "Auftrag" (Local Purchase Order (LPO)) is provided by an OPA. It is the individual car owner's responsibility to obtain this if the insurance company (either his/hers or the third party's company) so request. As with any other purchase, the Auftrag must be obtained in advance of the repair being carried out - i.e. obtain "Auftrag", the produce it to the garage; the garage then completes the repair and payment is the made by the OPA to the garage. Some insurance companies are reluctant to pay the individual car owner the sum direct (perhaps assuming that the money may not go toward the car repairs) and have in the past made the payment direct to the garage, this is not allowed and under no circumstances are insurance companies to make tax-exempt payments directly to garages undertaking the repairs.

The insurance company therefore has two options; either pay the individual who will then pay the OPA or to pay the sum direct to the OPA; in either case it is the OPA who will make the payment to the garage.

When the individual submits his/her claim to the insurance company he/she should include any admin costs associated with the process such as the cost of the "Auftrag" as these should also be paid by the insurance company, less of course any voluntary excess associated with the policy.

There is one other condition which applies when a third party (non-SOFA-status) person is at fault. In this case the member of BFG is not to be directed to obtain their repair services from a company chosen by the third party or third party's insurance company. In other words, members of BFG are able, in conjunction with their own insurance company, to determine where they have the repairs made on the damaged vehicle.
